变通VS死板

常常听到人们在说,规矩是死的,人是活的;但是,在没有亲身体验政府机构的庞大体系如何运作之前,你真的无法清楚地知道什么是死板。

政府经常被标签成“繁文缛节”,很多时候,都是部分公务员过度“遵从条规”,不敢变通的结局。

单是我所主持的每周土地理事会会议,就有够多故事可以讲了。每次会议提呈的30多项申请,起码有四五项是可以灵活变通处理的,在此与大家分享几项:

一)一名在经营养殖鱼活动的业者进书,要在槟岛海岸申请海面地作为养殖用途。尽管各部门对有关地点毫无异议,但官员给的建议是不能批准,因他已在另一处有一个养殖场,不许剥夺其他人的拥地权。

我真的纳闷,同一地段目前无人申请,而海洋不像地皮那么有限,其他人若想申请,还有一大片汪洋可以申请啊,何来“剥夺”之说?土地局当初的决定,也仅基于技术问题。最后,申请获批了。

二)一个提呈耕地的申请者,只要960方尺作为小型鸡鸭养饲场。不巧的是,其申请地落在道路保留地,所以官员建议不能批。我翻看地理位置,这是位于偏僻地区的一条死路,在一个甘榜的尾端,根本无路可建,也没有人会走。所以就推翻了这项决定,让小农民有自己的耕种地。

三) 位于槟霹边界的沿界路段,一个平民要在道路保留地建住 家。官员说那是保留地不能批。我看了图,横跨槟霹,需要的是横跨两地的路,而不是沿着边界的路吧?给别人一条出路,叫他做路开路,也给自己一条生路,何乐而不为呢?

四)在阿曼岛一名养蛤业者投书,说他那82依格的海上养蛤场,因垃圾船川行导致海水污染,海产欠收,所以要求将他每年缴交的3千400令吉地税,减60%至每年1千令吉,但面积维持。我认同污染问题,但是,这建议也太占政府便宜了吧?减税没问题,但是你的面积也应该同样的减60%啊!官员才恍然大悟—原来真的可以这么做!

五)在土地法典下,国能等基建公司欲“路过”私人产业建基设,也必须作出赔偿,而且这些案例不能被带上法庭,州政府是最后决定者。估价师给的价格是每平方公尺400令吉,国能建议的赔偿额是415令吉。官员说,评估额有异,批不得。算了算总面积,分别只有841令吉,多付这笔钱,国能会破产吗?至少能让这老妇业主多一笔收入。

这些案例,证明我的官员执行时并无滥权,不过是过度墨守成规。他们不敢变通,害怕需要负起责任,所以,我得从一次又一次的经验,慢慢让他们开窍,不是每个情况都必需死死板板依规行事的,只要是以民为本的,都可以灵活处理,才能展现活力,显示出人治政府的意义。

    Mr CM,

    I like you article of 变通VS死板. I had a case, wish the Mr CM will help to solve it.

    I had submitted a Planning Permission to MPPP but my plan get rejected. I don’t understand why a 2 storey semi-detached house application will get rejected. Can you please have a look on MPPP/OSC/PM(1166)/10(LB) & MPPP/OSC/PM(1165)/10(LB).

    We submitted the plan, follow all requirement by internal and external department. But, because of the coloring matter (we had written everything inside the plan clearly). they rejected the plan. If they know 变通, they can approved the plan with condition and informed us to amend and give us the approval.

    Now, we need to re-submit everything, going through again the OSC process. This will take minimum 3 months time. This is wasting your staff time to comments again on the same project, wasted the printing, cost etc(are we going for green city?). It’s not efficient.

    I really hope Mr CM will look into this matter. I do need the approval to built the house..

      Please refer back to the rejection letter.
      You need to consult your consultant or architect where you mistake done in your plan which is coloring matter,
      you have to re-submit your planning permission with a correct coloring.
      OSC process takes time because it involved many departments.

    Mr CM,

    I haven’t receive the rejection letter but i hear the plan get rejected on 31 may 2011 meeting. That is why i am trying to find solution and hope to get the approval before they release the rejection letter.

    Is it possible to table the plan again in next meeting? i will get the approval from JKR. Just pending JKR approval. Before that, we meet and submitting the plan to JKR, they do not comment about the matter. But, after the plan rejected, now they tell us we need to add in the color. I feel it’s not fair.

    I really hope there is a way to solve this problem. I know an application involved in many departments, therefore, i hope this project do not need to going through again the OSC process.
